How unused leave compensation is calculated

At the end of the contract, unused holiday days are compensated in cash (art. 144, 146 Labour Code). The formula: remaining days × the average daily indemnity, where the daily indemnity is derived from the 3-month average of pay (base salary + permanent bonuses), divided by the working days.

What counts in the base

The base includes the base salary and permanent bonuses. It does not include occasional bonuses, irregular premiums or meal vouchers. Confusing permanent and occasional elements is the most common source of error.

When are unused holiday days paid?
Only at the end of the contract. During the contract, the right to leave cannot be replaced with money (except upon termination).
What counts in the calculation base?
The base salary and permanent bonuses over the last 3 months. Occasional bonuses and vouchers are not included.
Does the reason for leaving change the right?
No. Compensation is granted regardless of the reason for termination — resignation, dismissal, mutual agreement or termination by law.
